This Acceptable Use Policy ("Policy") applies to your use of Hello Gubby's platform and services, including voice AI, chat, SMS, widgets, and all related features (collectively, the "Services"). This Policy is part of our Terms of Service.

Hello Gubby is built to help businesses serve their customers better. To keep the platform safe and effective for everyone, we require all users to follow these guidelines.

General Requirements

When using Hello Gubby, you agree to use the Services only for lawful business purposes, comply with all applicable laws and regulations in your jurisdiction, provide accurate information about your business, and obtain proper consent from callers and contacts when required by law.

Prohibited Uses

You may not use Hello Gubby for any of the following:

Illegal Activity

Any activity that violates local, provincial, state, federal, or international law. This includes fraud, scams, phishing, or any attempt to deceive or mislead callers. It also includes facilitating illegal transactions, promoting illegal goods or services, or violating intellectual property rights.

Harmful or Abusive Content

Content or communications that threaten, harass, bully, or intimidate any person. Hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic. Content that promotes violence, self harm, or exploitation of any kind.

Spam and Unauthorized Communications

Sending unsolicited bulk calls, messages, or communications. Using the platform for robocalling without proper consent. Violating the Telephone Consumer Protection Act (TCPA), CAN SPAM Act, Canadian Anti Spam Legislation (CASL), or similar regulations in your jurisdiction.

Impersonation and Deception

Impersonating another person, business, or organization. Creating false caller ID identities or misrepresenting the origin of communications. Using AI voices to deceive callers about whether they are speaking with a human or an AI, except where disclosure is properly made.

Election and Political Misuse

Voter suppression, election interference, or spreading electoral misinformation. Impersonating political candidates or government officials. Unauthorized political campaigning or robocalls.

Harm to Minors

Any content or activity that exploits, harms, or endangers children. Using the Services to contact or collect information from individuals under 16 years of age.

Security Violations

Attempting to access systems, data, or accounts without authorization. Interfering with, disrupting, or attacking the platform or its infrastructure. Reverse engineering, decompiling, or attempting to extract source code from the Services. Introducing viruses, malware, or other harmful code.

Misuse of AI Features

Using AI outputs for decisions that could have legal or material impact on individuals without human review (such as employment, credit, housing, insurance, or medical decisions). Training competing AI models using Hello Gubby outputs. Using the platform to generate content that violates this Policy.

Regulated Industries Without Compliance

Providing medical advice or handling protected health information without proper HIPAA compliance measures. Handling financial transactions or advice in violation of applicable regulations. Operating in regulated industries without required licenses or authorizations.

Your Responsibilities

You are responsible for all activity that occurs through your account. You are responsible for ensuring your use of the Services complies with all applicable laws, including call recording notification requirements in your jurisdiction. You must disclose to callers that they are interacting with AI when required by law or when callers ask directly.

Reporting Violations

If you become aware of any violation of this Policy, please report it to us at hello@hellogubby.ai. We take all reports seriously and will investigate promptly.

Enforcement

We reserve the right to investigate suspected violations of this Policy. If we determine that a violation has occurred, we may take action including issuing warnings, suspending or terminating your account, removing content, and reporting illegal activity to appropriate authorities.

We may take these actions without prior notice if we believe there is risk of harm, legal liability, or damage to our platform or other users.

Changes to This Policy

We may update this Policy from time to time. We will notify you of material changes via email or through the Services. Continued use of Hello Gubby after changes take effect constitutes acceptance of the updated Policy.
